Todd Martin
Todd Martin is a shareholder in the Reinhart Boerner Van Deuren s.c.'s employee benefits department and a member of the firm's tax, executive compensation, and employment law groups. Todd also chairs the firm's interdisciplinary insurance group. Todd's clients benefit from his many years experience practicing insurance regulatory law (with a special emphasis on life and health), employee health and welfare and retirement plans and policies, and related employment law issues. Todd's clients include many fraternal benefit societies, insurers, employers, and third-party plan administrators. He also serves not-for-profit organizations in the capacity of offsite general counsel, providing day-to-day guidance, proactive planning and troubleshooting for not-for-profit executives and managers.
Todd's insurance practice includes policy drafting and form filing, licensing, agent contracting, market conduct and privacy. He also advises on corporate matters including formations, contracts, and mergers and acquisitions. Todd serves as chair of the Insurance Law Committee of the State Bar of Wisconsin.
Todd's special relationship with fraternal benefit societies grew out of the more than seven years he spent in the corporate legal department of Thrivent Financial for Lutherans in addition to his service on the merger team for the merger of Fortune 500 fraternal benefit societies, Aid Association for Lutherans, and Lutheran Brotherhood. Todd's inside knowledge and understanding of the missionof fraternal benefit societies underpins his credibility in advising them in all areas including governance, insurance regulatory matters, lodge activities and requirements, dispute resolution, membership, product distribution, contracting, and mergers and acquisitions. He currently serves as general counsel to the National Fraternal Congress of America.
In addition, Todd serves a wide range of clients on legal issues arising out of fully insured and selfinsured health insurance, qualified retirement plans, and other employee benefit plans. He regularly provides practical advice to employers, insurers and third-party plan administrators on COBRA, HIPAA, FMLA, ERISA, and USERRA. He also provides advice on health, dental, health flex, vision, cafeteria, disability, group term life, dependent care, adoption assistance, travel fringe and other welfare benefits. He has particular expertise in the area of consumerdriven health care on which he has written and spoken extensively to HR professionals and business audiences. He also regularly provides advice on fiduciary duties associated with benefit plans.
Todd's clients frequently rely upon him for advice on employment law matters related to benefit plans including executive compensation and deferral in qualified and non-qualified plans, non-compete and other employment agreements, ADA and other employment discrimination matters, privacy, and FMLA and other leave programs and policies. He is knowledgeable on severance plans and policies, reductions in force and employment and employee benefits matters associated with mergers and acquisitions.
Todd's professional affiliations include membership in the American Bar Association, the Association of Fraternal Benefit Council, the State Bar of Wisconsin, and the Worldwide Employee Benefits Network, Madison Pension Council, and his chairmanship of the State Bar of Wisconsin Insurance Committee. His community activities have included board membership of Forward Service Corporation, past chairmanship and secretary of the Aid Association for Lutherans Branch 3850, and past directorship of the Boys and Girls Club-Fox Valley.
A management and finance graduate of Wisconsin Lutheran College (summa cum laude), Todd received his law degree (cum laude), from the University of Wisconsin Law School.
A native of Wisconsin, outside of his practice, Todd enjoys skiing up north with his young family, golfing, and losing his voice at University of Wisconsin sporting events.
